1. Introduction
TydeCo U (Pty) Ltd (“TydeCo U,” “we,” “us,” or “our”) is committed to protecting personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”) and other applicable South African laws.
This Privacy Policy describes how we collect, use, disclose, transfer, retain, and safeguard personal information in connection with:
- Our South Africa-facing website;
- Marketing communications and event registrations;
- Recruitment activities;
- Consulting, implementation, and support services; and
- Software licensing and related professional services.
For purposes of POPIA, TydeCo U (Pty) Ltd acts as the “Responsible Party” when determining the purpose and means of processing personal information.
2. Scope
This Privacy Policy applies to:

- Prospective and current business customers;
- Representatives of customer organizations;
- Job applicants;
- Vendors and service providers; and
- Individuals who communicate with us.
This Policy does not govern the privacy practices of third-party software vendors whose products we implement, resell, or support.

Under POPIA, “Personal Information” means information relating to an identifiable, living natural person and, where applicable, an identifiable juristic person.

D. Client-Related Information
In the course of providing consulting, implementation, and support services, we may access personal information contained within customer systems. This may include financial or employee-related data where necessary to configure or implement software solutions.
TydeCo U (Pty) Ltd does not provide outsourced payroll or accounting services in South Africa. However, during advisory or implementation engagements, we may access or view personal information solely for the purpose of providing contracted services.
4. Lawful Basis for Processing
We process Personal Information in accordance with the conditions for lawful processing set out in POPIA, including where:
- The data subject has provided consent;
- Processing is necessary to perform a contract;
- Processing complies with a legal obligation;
- Processing protects a legitimate interest of the data subject; or
- Processing is necessary for our legitimate business interests, provided such interests are not overridden by the data subject’s rights.
5. Purpose of Processing
We process Personal Information for the following purposes:
- To provide consulting, implementation, and support services;
- To manage software licensing relationships;
- To respond to inquiries and event registrations;
- To communicate with customers and prospects;
- To administer recruitment processes;
- To comply with legal and regulatory obligations; and
- To enforce contractual rights.
We will not process Personal Information for purposes that are incompatible with those described above.
6. Special Personal Information
We do not intentionally collect or process Special Personal Information as defined under POPIA unless required for lawful purposes or where processing is permitted under applicable law.
If Special Personal Information is encountered during the provision of services, it will be processed strictly in accordance with POPIA and applicable safeguards.
7. Disclosure of Personal Information
We may disclose Personal Information to:
- Cloud infrastructure providers (including Microsoft Azure and Office 365);
- CRM and marketing platforms (including HubSpot);
- Professional advisors (legal, accounting, compliance);
- Third-party software vendors where required for implementation or support; and
- Regulatory or governmental authorities where required by law.
We require service providers to maintain appropriate security safeguards.
8. Cross-Border Transfers
Due to our global infrastructure, Personal Information may be transferred outside South Africa, including to the United States and other jurisdictions.
Where Personal Information is transferred outside South Africa, we will ensure that such transfer complies with Section 72 of POPIA, including by ensuring that:
- The recipient is subject to a law, binding corporate rules, or binding agreement that provides an adequate level of protection; or
- The data subject consents to the transfer; or
- The transfer is otherwise permitted under POPIA.
9. Security Safeguards
We implement appropriate, reasonable technical and organizational measures to prevent loss, damage, unauthorized destruction, and unlawful access to or processing of Personal Information, including:
- Role-based access controls;
- Multi-factor authentication;
- Encryption where appropriate;
- Secure cloud infrastructure;
- Confidentiality obligations for personnel.
10. Retention
We retain Personal Information only for as long as necessary to achieve the purposes for which it was collected, to comply with legal obligations, or to resolve disputes.
When Personal Information is no longer required, it is securely destroyed or de-identified.
11. Data Subject Rights
In accordance with POPIA, data subjects have the right to:
- Request access to their Personal Information;
- Request correction, deletion, or destruction of inaccurate or excessive Personal Information;
- Object to processing in certain circumstances;
- Withdraw consent where processing is based on consent; and
- Lodge a complaint with the Information Regulator.

12. Direct Marketing
We will only process Personal Information for direct marketing purposes by electronic communication where permitted by POPIA and other applicable laws. Data subjects may opt out of marketing communications at any time.
13. Information Officer
TydeCo U (Pty) Ltd has appointed an Information Officer responsible for ensuring compliance with POPIA.

14. Complaints
If a data subject believes that their Personal Information has been processed unlawfully, they may contact our Information Officer. If concerns are not resolved, a complaint may be lodged with the South African Information Regulator.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Updates will be posted on our website with a revised “Last Updated” date. The version in effect at the time of collection or service engagement will govern, unless otherwise required by law.
